Halle Berry Faces Major Custody Setback as Judge Restricts Time With Son Maceo
Halle Berry has faced a major setback in her custody dispute with ex-husband Olivier Martinez after a Los Angeles County judge temporarily restricted the actress’s visitation with their son Maceo.
According to People, the court approved a temporary restraining order requested by Martinez on Thursday, October 1, introducing new limits on when Berry can spend time with their son.
Court records reviewed by the publication reportedly show that Berry’s visits with Maceo are currently restricted to Mondays, Tuesdays, Saturdays and Sundays between 10 a.m. and 8 p.m.
However, the judge did not grant every measure requested by Martinez. His request for monitoring of Berry’s sobriety was denied because the court found there was “insufficient information” to support it.
The legal action follows serious allegations made by Martinez in his petition concerning an incident he claims occurred between Berry and their son on September 26.
Martinez alleged in the filing that Berry had “physically abused our son, Maceo, by jumping on him, putting her hands around his neck, and choking him.”
He further claimed that Maceo contacted him seeking help during the alleged incident. The accusations remain allegations made as part of an ongoing custody dispute and have been strongly denied by Berry’s legal team.
Berry’s attorney Marina Beck responded in a statement to Entertainment Weekly, rejecting Martinez’s version of events and describing his filing as misleading.
“To say this filing is entirely meritless and deliberately misleading would be an understatement,” Beck said while defending the Oscar-winning actress against the allegations.
Berry’s legal team also turned criticism towards Martinez, accusing him of interfering with therapeutic and educational interventions involving their son.
Beck maintained that Berry remains focused on Maceo’s wellbeing and said the actress would continue “fighting for Maceo’s best interests” as the dispute moves forward.
Martinez is reportedly seeking full custody of their son, potentially setting the stage for another significant legal battle between the former couple over their parenting arrangements.
Berry and Martinez married in 2013 and announced their separation in 2015. Their divorce was ultimately finalised in 2023 after years of negotiations concerning financial and custody matters.
Berry is also mother to 18-year-old daughter Nahla, whom she shares with former partner Gabriel Aubry. For now, the restrictions involving Maceo are temporary, while the competing allegations remain before the court. The judge’s decision to grant temporary restrictions does not by itself determine the ultimate custody outcome or establish the disputed allegations as proven facts.
